Who can use MindLoops
- You must be at least 16 years old. If you’re under the age of majority where you live, you confirm that a parent or guardian has agreed to these terms.
- Your account is for you alone. Give us a real email address, keep your password safe, and tell us straight away if you think someone else is using your account. You’re responsible for what happens in it.
- You can’t use MindLoops if the law where you live forbids it, or if we’ve previously ended your account for breaking these terms.
What MindLoops is, and isn’t
MindLoops helps you make loops of short notes, mostly by talking through what you want, and hear them read aloud on repeat. It’s a tool for practising the way you talk to yourself.
MindLoops isn’t medical, psychological or other professional advice, treatment or therapy, and it isn’t a crisis service. We don’t monitor what you say in real time and can’t respond to emergencies. If you’re struggling, please talk to a professional or someone you trust. If you’re in danger, call your local emergency number. You can find free, confidential support lines at findahelpline.com.
Everyone is different, and we don’t promise any particular result from using MindLoops.
Your content
“Your content” means what you put into MindLoops: your loops and notes, your interview recordings and answers, and your voice copy. It’s yours, and you keep all your rights in it.
So that we can run MindLoops, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, process, transcribe, adapt and turn your content into speech, only to provide, protect and improve MindLoops for you, as our privacy policy describes. This licence ends when you delete the content or your account, except for copies other members already made of loops you made public.
Public loops. If you make a loop public, anyone can see it and listen to it, and other members can copy it into their own loops, edit their copy and keep it, even if you later make yours private or delete it. You give them, and us, the rights needed for that.
You’re responsible for your content. Only add what you have the right to use, and nothing that breaks the law or these terms. We may remove content, or make a public loop private, if we believe it breaks these terms, and we’ll tell you when we can.
If you send us ideas or feedback, we may use them freely, without owing you anything.
AI features
- Parts of MindLoops use AI: after the first question, the interview’s questions, the tidied versions of your answers, and your loops are written by AI models.
- AI can be wrong, incomplete or simply not what you meant. Check every answer and note, edit them until they’re right, and don’t rely on them for decisions about your health, money, legal matters or safety.
- Answers and loops are checked automatically for safety. If a check is triggered, the interview stops and no loop is written, and we may not be able to tell you exactly why.
- As between you and us, the text of your loops belongs to you, including the parts AI wrote. AI can produce similar text for other people, so it may not be unique.
Your voice
- With Prime, you can ask MindLoops to make a copy of your voice. You may only make a copy of your own voice, from recordings of yourself made in the app.
- Don’t try to make a copy of anyone else’s voice, use recordings of other people, or use your voice copy to deceive or impersonate anyone.
- Your voice copy is used only to speak your loops, and only you can use it.
- You can improve or delete it at any time. Improving it means notes already spoken in your voice are spoken again the next time they play, which uses words.
- If your Prime ends, your voice copy is paused and may be deleted. If we believe a voice copy is being misused, we may delete it and suspend your account.
Free and Prime
Free. Free accounts get 5,000 words of realistic voice, once, plus your iPhone’s built-in voice with no word limit.
Prime is one payment for 365 days. It’s not a subscription and never renews automatically. Each purchase adds 10,000 words of realistic voice to use while your Prime is active, and unlocks your own voice. Buying again while Prime is active adds another 365 days and another 10,000 words. When Prime ends, you’re back on Free, and unused Prime words expire.
Words. Words are counted when realistic speech is generated for new or edited notes. Replaying audio that’s already been generated doesn’t use words.
Fair use. To keep MindLoops fast and fair for everyone, some features, like making loops with AI, have daily limits.
Payments and refunds. Purchases in the app are processed by Apple under the App Store’s terms, and Apple handles refunds: you can ask for one at reportaproblem.apple.com. Prices can change, but never for something you’ve already bought.
Changes to plans. We may change what Free and Prime include in the future. We won’t reduce a year of Prime you’ve already paid for, except where we must by law or to stop abuse.
Using MindLoops fairly
Please don’t:
- break the law, or help anyone else to;
- add or share content that harasses, threatens or demeans people, sexualizes minors, promotes violence or self-harm, or infringes anyone’s rights;
- share other people’s private information without their permission;
- impersonate anyone, or make a copy of any voice but your own;
- try to get around safety checks, word allowances, daily limits or security measures;
- access other people’s accounts or data, or try to;
- scrape, copy in bulk, reverse-engineer or disrupt MindLoops, except where the law expressly allows it;
- use MindLoops or its content to train AI models or build a competing product;
- resell or sublicense MindLoops.
Our property
MindLoops itself (the app, the website, our designs, logo, voices and music) belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable licence to use the app on devices you own or control, for your own non-commercial use, under these terms and the App Store’s rules. These terms don’t give you any rights in our name or brand.
Other services
MindLoops relies on services run by others, such as Apple’s App Store and the AI and voice providers we use to make and read your loops. Their terms may also apply to you, Apple’s for example. We’re not responsible for services we don’t control, or for other websites we link to.
Changes to MindLoops and these terms
We’re always improving MindLoops, so features may change, be added or be removed, and we may pause it briefly for maintenance. If we ever shut MindLoops down for good, we’ll give you reasonable notice and, if you have Prime time left, a fair remedy, such as a pro-rata refund, where the law requires it.
We may update these terms. If a change is significant, we’ll tell you in the app or by email at least 14 days before it takes effect, unless it’s needed sooner for legal or safety reasons. If you keep using MindLoops after a change takes effect, the new terms apply; if you don’t agree, stop using MindLoops and delete your account.
Ending things
You can stop using MindLoops at any time, and delete your account in the app: Profile, then Delete account. If you can’t use the app, email louis@nicheless.com and we’ll delete it for you. Deleting your account ends any Prime time you have left and doesn’t refund it; refunds go through Apple (see Free and Prime).
We may suspend or end your access if you seriously or repeatedly break these terms, if the law requires it, or to protect other people or MindLoops. Unless the law or someone’s safety prevents it, we’ll tell you why. If we end your account without a good reason, we’ll refund any unused Prime time pro rata.
The sections about your content, our property, disclaimers, liability and disputes still apply after your account ends.
Disclaimers
We work hard to make MindLoops reliable and helpful, but we provide it “as is” and “as available”. To the extent the law allows, we don’t make promises beyond those in these terms, including that MindLoops will always be available or free of errors, or that it will suit a particular purpose. Nothing in these terms limits rights you have as a consumer that can’t be limited by contract.
Liability
To the extent the law allows:
- we’re not liable for indirect, incidental, special or consequential losses, or for lost profits, data or goodwill;
- our total liability to you for any claim relating to MindLoops is limited to the greater of what you paid us in the 12 months before the claim, or US$50.
None of this limits liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t let us limit.
If you use MindLoops in a way that breaks these terms or the law, and someone brings a claim against us because of it, you agree to cover our reasonable costs, to the extent the law allows.
Disputes and governing law
If something’s wrong, please email us first: most problems can be sorted out quickly, and we’ll try to resolve yours within 30 days.
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules, and the state and federal courts located in Delaware have jurisdiction over disputes about them. If you’re a consumer living elsewhere, you keep the protection of the mandatory laws of the place where you live, and you can also bring a claim in your local courts.
If you got MindLoops from the App Store
If you downloaded MindLoops from Apple’s App Store, these terms also include the following:
- These terms are between you and Nicheless, Inc., not Apple. Apple isn’t responsible for the app or its content.
- Your licence to use the app is limited to Apple-branded devices you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you can notify Apple, and Apple will refund the purchase price, if any, of the app. To the maximum extent the law allows, Apple has no other warranty obligation for the app.
- Nicheless, Inc., not Apple, is responsible for addressing any claims relating to the app or your use of it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If anyone claims the app or your use of it infringes their intellectual property, Nicheless, Inc., not Apple, is responsible for investigating, defending, settling and discharging the claim.
- You confirm that you’re not in a country subject to a US Government embargo or designated by the US Government as “terrorist supporting”, and that you’re not on any US Government list of prohibited or restricted parties.
- You must follow any third-party terms that apply when you use the app, such as your mobile data agreement.
- Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, have the right to enforce them against you.
- Questions, complaints or claims about the app go to Nicheless, Inc. at louis@nicheless.com.
The fine print
- These terms and our privacy policy are the whole agreement between you and us about MindLoops.
- If part of these terms can’t be enforced, the rest still applies.
- If we don’t enforce part of these terms straight away, we can still enforce it later.
- We may transfer these terms if MindLoops is merged or sold. You can’t transfer them without our permission.
- We’ll send notices to the email address on your account, or show them in the app.
- If we translate these terms, the English version is the one that applies.
